Terms of use
User needs
Users must be of legal age (or have reached the age of majority in the jurisdiction in which they operate) to use Gig services.
To create or order a Gig, you must register with a valid e-mail address or social network account. Each user may create only one account. Gig reserves the right to delete duplicate accounts.
The user has the right to delete his/her account at any time, only after all orders on his/her account have been completed and delivered. If the user decides to delete his/her account, he/she accepts the definitive deletion of this account. Accounts deleted in error can be restored within 30 days by contacting Gig’s support team. Under no circumstances will the user be able to create a new account using the same e-mail address, telephone number and payment details used in a previously deleted account. If the user has funds in his balance prior to deleting his account, he must withdraw all funds prior to such deletion. Users will not be able to delete their account unless all funds have been withdrawn.
You cannot buy, sell, offer or share a Gig account.
Users are responsible for protecting their authentication information to prevent malicious use of the Service by third parties, and must promptly notify Gig of any abuse of the service.
Users are individually responsible for all content posted on Gig, including, but not limited to, Gigs, images, videos, reviews and comments. By creating an account on Gig, users confirm that they understand and agree to these terms, and also agree to reimburse all expenses incurred by Gig in the event of a copyright infringement claim against Gig.
The User accepts that it is not considered a worker, employee or agent of Gig, and that it does not have the right to present itself as such.
The User may not assign its rights and obligations hereunder in whole or in part. Gig may assign its rights and obligations hereunder or any of its rights and obligations hereunder without User’s consent at any time.
Profanity, vulgarity, unauthorized advertising and the publication of information and material damaging to Gig’s brand image are prohibited. A complete list of prohibited content is available here.
Gig reserves the right to delete any content posted on the Gig services, including but not limited to gigs, reviews, comments, etc., as well as to suspend or delete a user’s account without explanation. In the event of suspected unauthorized access, spam or other suspicious activity on your account, Gig may temporarily suspend the account until the account is deemed secure again. In the case of blocked accounts, the user may complete any outstanding orders, but may not accept or begin work on new orders. Users may withdraw money from their balance to the registered credit/debit card or any other withdrawal method available on the “Cash Flow” page. Users will only be able to communicate with the helpdesk, while communications and chats with other users will be temporarily unavailable.
Contentious situations and problems, including financial issues, can be resolved by contacting Gig’s support team by e-mail or via a request submitted on gig.tn. The support team will investigate and work to resolve the issue. Unique issues without applicable rules or regulations will be resolved as the Gig Support Team deems appropriate.
You may not disclose information you obtain while logged into Gig, including, but not limited to, order specifications and terms and personal correspondence with other Gig users and representatives. You may disclose information about your Gigs, your earnings on Gig, and other information related to your account if such information does not violate the privacy of other users.
All sellers who earn income by offering services and fulfilling orders using Gig Services are solely responsible for their compliance with local laws and regulations, including, but not limited to, licensing regulations and tax laws.
At its sole discretion, Gig has the right to unilaterally terminate these Terms of Service at any time, including, without limitation, in the event of User’s breach of any provision of these Terms or any provision of any of the Related Documents.
In this document, “Related Documents” refer to Gig sur Gig copyright protection, prohibited services and the Gigs approval process, as well as the Gig services privacy policy and dispute resolution policy.
Account balance and inactivity
The Gig.tn balance is not intended to be used to hold money indefinitely. If an account is inactive for 1 year or more, it will be put on archive service. In this case, the inactive account will be charged $15 per month for the first year since activation of the archiving service, and $150 per month from the second year onwards.
Data Policy
By registering with Gig, you agree to your personal data being stored and processed and to receiving information from Gig, including newsletters by e-mail. Gig may collect, store and process user data (cookies, data, identifiers) as necessary to operate the website, to effectively implement the affiliate program and for promotional purposes. How and why Gig collects and processes your personal data is described in our Privacy Policy.
Gig may exercise control over personal correspondence between users in order to ensure compliance with the Terms of Use and related documents. This includes Gig’s right to view the content of personal correspondence.
Terms & Conditions
Gig is an online digital marketplace where companies and individuals can buy and sell independent services.
Buyers are users who purchase freelance services from Gig, and are organized into tiers.
Sellers are users who sell freelance services on Gig, and are divided into levels.
Each user can be both seller and buyer at the same time.
A Gig is a freelance service offered on the Marketplace. The minimum fixed price for a Gig is $10.
The Gig account is the personal section of Gig, specific to each user. Users can access their accounts by entering authentication information on the Gig login page.
The portfolio is a collection of samples of a vendor’s work.
The Marketplace refers to all Gigs offered by Sellers on Gig as a whole. Buyers visit the Marketplace to purchase Gigs from Sellers.
Service packages are bundles of services that vendors can offer together to target different audiences and price points.
Extra options are additional services that sellers can offer over and above the main service provided in a Gig.
The Gig page is the page dedicated to each individual Gig. Buyers can buy, read reviews and find out more about a Gig on the Gig page.
The order page is where buyers and sellers communicate with each other about a purchased concert.
Task-based orders are orders divided into portions, and each specific task is processed and delivered separately.
Custom concert offers are personalized concerts that sellers can create to meet a buyer’s specific needs.
Custom concert requests are requests that buyers can send to sellers for a custom concert offer.
Gig’s Choice is a coveted badge awarded to gigs that buyers love for their high-quality work and fast delivery.
Your balance includes your earnings as a seller and payments refunded after cancellation of an order (as a buyer). You can check your balance on your Gig.tn account.
Partners are payment systems or other services that provide, store or receive payments.
Earnings are the money that Sellers receive from completed orders and can either withdraw or use for purchases on the Gig Services in accordance with these Terms of Service.
Gigs
The creation of Gigs is free of charge. A new seller can create 1 Gig. After successful account verification, a seller can create 10 Gigs.
Each Gig is manually approved by a support specialist before being published on the Marketplace. Gig reserves the right to edit or remove Gigs that violate these Terms of Use and/or associated Documents. Users can learn more about the Gig approval process here.
By selling a Gig, Sellers agree to provide all included services for all Gig orders. Sellers do not have the right to refuse to sell an active Gig to a Buyer who pays for the order and provides all information necessary to complete it. Sellers provide their services to Buyers independently and assume full responsibility for the fulfillment or non-fulfillment of all orders. It is forbidden to divide a single order for the same service into several smaller orders (i.e. to create duplicate orders) in order to artificially increase the total number of orders for a Seller. In such cases, Gig reserves the right to penalize Gigs and/or the User.
Sellers are prohibited from misleading buyers regarding the services they provide. Any violation will result in sanctions and/or permanent suspension of the offending Gig and/or the seller’s account.
If a violation is reported, Gig has the right to remove this content.
If deemed appropriate, Gig reserves the right to unilaterally hide works from a user’s portfolio.
Sellers must remove any errors, mistakes or inconsistencies on a Gig’s page as soon as they are discovered. A common error is a discrepancy between the scope, delivery, price and other fields of a Gig. For example, suppose a seller writes in his Gig description that the scope of his Gig is 1,000 words, but enters 2,000 words in the “Scope of this Gig” field. In this case, the actual volume will be considered to be 2,000 words. The information given in the dedicated field shall prevail and take precedence over all other information. Any disputes arising from such discrepancies will be resolved in favor of the purchaser.
Orders
Buyers are required to pay for their orders in advance. Payments are held securely by the partners until the order is finalized.
Before placing an order, the user (seller) must ensure that it complies with Gig’s list of prohibited services. If the buyer requests a prohibited service, the seller must cancel the order and contact the support team.
If a buyer’s assignment differs from the service described by the seller, and the seller has accepted the order, priority is given to the buyer’s assignment. Assignments can be placed by correspondence before an order is placed, as well as when a Gig is ordered.
Order completion
An order is marked as completed after it has been approved by the Buyer or after arbitration has been completed.
Once the order has been delivered, the buyer has three working days (or four days if several days fall on a weekend) to approve the delivery. If, during this period, the buyer does not approve or request revisions, the order will be automatically approved and considered complete. If the order price exceeds $150, the approval period is five working days (or six if several days fall on a weekend).
A task-based order is considered complete when the final task is delivered and approved by the buyer. If a task is not approved, or if no revisions are requested, the task will be automatically approved and marked as completed after three working days (or four days if more than one day falls on a weekend). If the job price exceeds $150, the approval period is five working days (or six if more than one day falls on a weekend).
In this case, the entire order will be suspended and will only resume once the next task has been paid for. If the Buyer does not pay for the next task within five days, the Seller will not be able to start work on it. At the same time, completed jobs cannot be cancelled.
In accordance with Gig rules, the seller’s delivery must be of high quality. If a delivery contains an excessive number of objectively verifiable errors, the order is considered incomplete.
In accordance with Gig’s rules, if a buyer cannot verify a seller’s delivery (for example, if the seller does not provide proof of work or final product), the order is considered incomplete.
Revisions and Additional Services
Orders that meet the criteria described in the service description and the buyer’s requirements are to be considered successfully completed. If an order is not fulfilled, clearly does not meet the standards explicitly defined on the service page, or does not meet the buyer’s ordering requirements, the buyer may return the delivered work to the seller for revision. In this case, sellers must provide as many revisions as possible until the delivery meets the agreed standards without requesting additional payment.
Additional services (including revisions beyond those necessary for the order to be considered successfully completed) are offered at the Seller’s discretion. Sellers may determine the volume of service they are willing to offer and the price. Sellers may also choose not to offer additional services or revisions or to offer them free of charge.
Order cancellation
Sellers and buyers have the right to cancel any order by providing a valid reason for cancellation. Once the cancellation has been confirmed by the other party, payment will be refunded to the buyer. If a buyer chooses to cancel an order because a seller has missed a deadline, the funds will be immediately returned to the buyer without the need for confirmation from the seller.
Orders cannot be cancelled on the basis of a buyer’s subjective assessment of a seller’s delivery as long as the service has been provided in accordance with the information provided on the Gig page.
Gig reserves the right to cancel any order that violates these terms of service at any time.
Gig reserves the right to cancel orders for any reason. The most common reasons for cancellation are :
- The seller does not accept the order within 24 hours or exceeds the deadline and does not respond for more than two weeks.
- Users display aggressive behavior, use order elements (such as personal information) against each other, or buyers threaten sellers with bad reviews.
- Users have provided or included material that infringes the intellectual property rights of a third party.
- Users refuse the delivery of services, files or information necessary for the execution of a Gig in order to obtain favorable opinions, additional services or additional payment.
- The Seller submits an order for approval without a complete result in order to extend the order lead time.
Sellers must deliver a product that matches the description of their service and meets all the buyer’s requirements. Failure to meet this requirement will allow the buyer to cancel the order and may damage the seller’s status. Once the deadline has passed, the order is marked as overdue.
Gig reserves the right to cancel any orders or completed tasks under task-based orders if they constitute a serious breach of Gig’s terms of service (e.g., the type of service is prohibited on Gig, or the order may be fraudulent, etc.). In such cases, the amount paid for the cancelled order or task will be refunded from the Buyer’s balance and will be deducted from the Seller’s balance or, if funds on the Seller’s balance are insufficient, from the Seller’s future earnings. Funds for such an order will be withdrawn from the Seller’s balance, regardless of when the order was completed.
Partial cancellation of an order is not possible. An order can only be cancelled in its entirety and with a valid reason for cancellation. Reasons for cancellation include, but are not limited to:
- The seller has used materials that infringe the intellectual property of another party.
- The Seller’s delivery is defective or does not work.
- The Buyer has not acquired the rights to commercial use of the delivery and, as indicated, has used the delivery for commercial purposes.
Intellectual Property Rights
All intellectual property rights related to the delivery of an order are transferred to the Buyer upon successful completion and payment of the order, unless otherwise agreed between the Buyer and the Seller. If the intellectual property relates to licensed items, the Seller is obliged to transfer the license or, where applicable, to provide the Buyer with reasonable warning of the need to acquire a corresponding additional license.
Any transfer or assignment of intellectual property to the Buyer will be subject to full payment of the Gig, and the delivery may not be used if payment is cancelled for any reason. Violation of this rule may result in suspension of a Buyer’s account.
Unless otherwise specified, Sellers are not entitled to receive and may not solicit from the Buyer all royalties derived from the sale of their work.
Some Gigs require the purchase of a license for commercial use. In such cases, if a user (purchaser) buys a Gig for personal use, the purchaser will own all the rights necessary for such use and will not need a license for commercial use. But if the buyer intends to use it for purposes directly or indirectly related to a commercial activity, or in any other way for profit, he or she will need to purchase a license for commercial use in the manner provided by the relevant Gig.
Contact information exchange
It is forbidden to solicit and provide contact information, including first and last name, e-mail address, telephone number and social network accounts, and to agree to communicate outside Gig. Any violation may result in account termination.
Exceptions are made for orders where the exchange of contact information is clearly necessary. Examples include, but are not limited to, the provision of an AdSense e-mail address to set up advertising campaigns, a link to a social networking account that a seller will develop and a Skype ID for consultancy services. Sellers must explicitly indicate the need for certain contact information in advance in their Gig description or when sending a personalized Gig offer.
Sellers agree that all private information provided by buyers is confidential and may not be transferred or used for any purpose other than the fulfillment of the order itself.
All interactions between buyers and sellers, including, but not limited to, order placement, payment, negotiation of terms and conditions and approval of delivery must take place within Gig Services.
Seller Reviews and Ratings
Once an order has been completed or cancelled, buyers can leave a review about their experience working with the seller and their impression of the seller’s service. Gig does not delete reviews unless there is a clear violation of Gig’s terms of service.
Positive and negative reviews influence a seller’s rating. Under no circumstances may sellers artificially inflate or increase their ratings. Sellers who engage in such activities will be penalized.
Sellers can ask buyers to leave reviews, but cannot explicitly request a positive review.
By posting reviews on Gig, users grant Gig exclusive, royalty-free, fully paid, perpetual and irrevocable worldwide unrestricted intellectual rights to such reviews. At the same time, Gig assumes no obligation with respect to the content of any reviews it may receive from users.
User-generated content
Gig is not responsible for user-generated content. However, if you come across content posted on Gig that may violate these terms of use, you should notify Gig via the feedback form located here. All requests are taken into account by support.
Any content uploaded by users to Gig is considered user-generated content. Gig makes reasonable efforts to monitor content uploaded to the Gig services, but cannot be held responsible for user-generated content. Users are individually responsible for their content and the consequences of its use, disclosure, storage and transmission.
Users are solely responsible for checking all files transmitted to gig.tn for viruses and malware.
Files provided in correspondence and purchase orders are kept on Gig for two years, after which they are deleted. Files of paid orders that the Seller has attached to the final submission of an order will be retained permanently.
By uploading or creating content on gig.tn and the Gig mobile application, you represent and warrant that you own or have obtained all necessary rights, licenses, consents, permissions, powers and/or authorities to use and/or upload such content and that such content or its use on Gig does not and will not:
- infringe or violate any intellectual property, proprietary or privacy rights, data protection rights or publicity rights of any third party;
- violate all applicable local, state, federal and international laws, regulations and conventions ;
- violate the intellectual property, policies and/or terms of service of any third party.
Users (buyers and sellers) agree that, unless explicitly stated otherwise, the content they create/download on gig.tn, including text, photos, videos, user photos, user videos and any other Gig information, including posting of completed work, may be used by Gig at its sole discretion for marketing and/or other purposes.
If a violation is reported, Gig has the right to remove this content.
Users agree to reimburse all expenses incurred by Gig in the event of a copyright claim against Gig.
Payments and finance
Gig Money Back Guarantee
While a seller works on a buyer’s order, the buyer’s payment is held securely by the partners. The partners provide users of Gig services with a tool for delivering, storing and receiving payments.
As part of Gig’s money-back guarantee and buyer protection program, buyers are entitled to a refund of their balance :
- instantly if the Buyer cancels the order within 20 minutes of placing it
- instantly if the seller does not begin work on the order within 24 hours of the order being placed
- instantly if the seller does not complete the order in time and the buyer chooses to cancel it
- immediately if the Buyer and Seller mutually agree to cancel the order
- as soon as a Gig support specialist examines the order if it is incomplete or incorrectly completed.
A fee of 1 D is charged for each of these scenarios, attributed to our partners. To initiate a refund, the Buyer must request cancellation of the order on the order page. Depending on the reason for cancellation, the order can be cancelled within 0 to 48 hours of the request.
No refund can be requested after the Buyer has confirmed that the order has been completed.
The refunded amount can be returned to our payment partner.
Order Payment
By making or receiving payments via Gig Services, you accept and agree to be bound by and comply with these terms.
Sellers and buyers agree to use the partner’s payment system for all transactions. It is forbidden to make payments outside the Gig services. If a user is asked to use another payment method, he/she should immediately contact the Gig support team.
Orders can be paid for by debit and credit card (including D17, Flouci or direct transfer from the Konnect wallet). Buyers may also use funds available on their balance. Additional payment methods may be available in some locations.
By ordering a Gig or custom offer, buyers agree to pay sellers for their services, as well as all associated commissions and fees. When they make a purchase, buyers see the total amount to be paid.
The Vendors agree that the transfer of the Partner’s Winnings is equivalent to the payment made by the Buyer directly to the Vendor.
Gig Service Fee
By using Gig.tn, users agree to pay Gig’s service fees.
Gig’s service fee is determined as follows : Gig’s service fee is included in the final price of a seller’s Gig or a customized Gig offer. Sellers pay a 10 % service fee on the total order value. Sellers receive an amount equal to the total order value minus the Gig service fee.
Example of a service charge :
Total order |
Service charge (10%) |
Seller wins |
100 DT |
10 DT |
90 DT |
200 DT |
20 DT |
180 DT |
500 DT |
50 DT |
450 DT |
In this structure, for a Gig priced at 100 DT, the service charge is 10 DT and the seller earns 90 DT. Similarly, for a Gig priced at 200 DT, the service charge is 20 DT and the seller earns 180 DT. The same calculation applies to higher order values.
Security
In the event of cancellation of an order, the funds paid will be returned to the Buyer’s balance. Refunds for cancelled orders are returned to the Buyer’s balance and are available for future purchases and withdrawals on Gig Services.
Questions related to the refund of payments are at Gig’s sole discretion.
To protect against fraud, unauthorized transactions (such as money laundering), claims or other liabilities, all payment information is collected either by Gig or by Partners. All orders are processed via a secure transaction. All paid funds are placed in an escrow account and transferred to the Seller only upon completion of the job. It is not possible to place any other type of order on Gig Services. It is forbidden to perform unpaid tasks (tests) and to carry out transactions outside the scope of the order. Violations will result in a penalty and/or freezing of your account.
Gig does not have access to payment information provided to Partners. This information is governed by the privacy policy of the Partners.
By making payments and/or providing payment information on Gig Services, you represent and warrant that :
- You are legally entitled to make payments on the Gig Services using the payment method you have chosen ;
- Your actions do not violate any applicable law.
You agree to receive invoices and/or payment receipts from Gig electronically as PDF documents, by e-mail or on gig.tn.
Withdrawal of funds
Funds refer to the money on a user’s balance. A seller receives funds for completing orders. A buyer may also have funds because their payment has been refunded following an order cancellation. Funds can be withdrawn or used for purchases from Gig services in accordance with these Terms of Service.
Users cannot withdraw funds acquired from promotional codes. Funds acquired from promotional codes can only be used for Gig purchases.
Users can create a withdrawal request from their account. Funds can be withdrawn to our payment partner’s account. All withdrawals are final and cannot be reversed.
Withdrawal days
Payments are made twice a month, on the 15th and 30th of each month (except on public holidays, in which case there will be a slight delay). The minimum withdrawal threshold is D200.
Taxes
Users are responsible for the payment of all direct or indirect taxes, or income tax, which may be applied to them based on their place of residence, location or otherwise, in accordance with the provisions of their jurisdiction. Sellers represent and warrant that they will at all times comply with their obligations under the income tax provisions of their jurisdiction.
Dispute resolution (arbitration)
Any dispute or disagreement between a seller and a buyer is resolved through individual negotiations or with the help of a specialist from the support team. If negotiations fail, either buyer or seller has the right to request arbitration.
To request arbitration, the user must click on the arbitration link under Help located on the order page, indicate the category concerned and complete the arbitration form. The arbitration link appears once the order has been submitted for approval. The request must contain the claimant’s username, the username of the other party to the dispute, the number and identification of the order in dispute, and evidence supporting your position in the dispute.
The request will be forwarded to a competent specialist in the concert support team (the arbitrator) to assess and resolve the dispute. A decision will be made within 3 working days; however, this period may be extended in exceptionally difficult circumstances.
Arbitrators do not evaluate the creative components of orders, including, but not limited to, colors, fonts and writing style (with the exception of deliveries that clearly do not meet the standards displayed in the Seller’s portfolio).
During the execution of an order, sellers must never take any action that could harm buyers. For example, sellers must not make changes or upload files that could harm the site or site users when working on site access. If a buyer is found to have been wronged by a seller, the arbitrator will cancel the order and the seller’s account will be penalized and/or suspended.
If an arbitrator discovers that an order constitutes a serious violation of Gig’s terms of service (e.g., the type of service is prohibited on Gig, or the order may be fraudulent, etc.), the arbitrator has the right to cancel the order and apply sanctions to both parties. If the order is fraudulent or in flagrant violation of the law, the Buyer’s payment will be returned to his credit/debit card. In all other cases, the funds will be returned to the Buyer’s balance.
If the seller and buyer have come to a mutual agreement regarding partial payment of the order, the Gig arbitrator will decide according to the wishes of both parties and the terms of service.
The buyer has the right to leave a notice on an order that ends in arbitration, even if the arbitrator rules in favor of the seller. The buyer may not leave a notice when it requests additional services from the seller that go beyond the initial scope of the order.
